These general terms and conditions (hereinafter, the “General Terms and Conditions”) govern the legal relationship arising from the contracting processes carried out between the user-customers (hereinafter, the “Customers”) of the Autocares Lact website located at the URL http://www. autocareslact.com, owned by Autocares Lact, S.L. (hereinafter, “Autocareslact.com”). Registered in the Mercantile Registry of Seville, at Folio 103 of Volume 1446, Eighth Registration, Sheet No. SE-5130.
Customers accept the General Terms and Conditions from the moment they use or purchase any product. This document may be printed and stored by Customers. Autocareslact.com provides them with the telephone number 954 63 02 04 and the email address [email protected] so that they may raise any questions regarding the General Terms and Conditions.
2.- Applicable rules
These General Terms and Conditions are subject to the provisions of Law 7/19988, of 13 April, on General Terms and Conditions of Contracting; Law 26/1984, of 19 July, General Law for the Protection of Consumers and Users; Royal Decree 1906/1999, of 17 December 1999, regulating Telephone or Electronic Contracting with general terms and conditions; Organic Law 15/1999, of 13 December, on the Protection of Personal Data; Law 7/1996, of 15 January, on the Regulation of Retail Trade; and Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce.
3.- Amendment of the General Terms and Conditions
Autocareslact.com may amend the General Terms and Conditions by notifying Customers sufficiently in advance, in order to improve the services and products offered through Autocareslact.com. By amending the General Terms and Conditions displayed on the Autocareslact.com website, this duty of notification shall be deemed fulfilled.
In any case, before using the services or purchasing products, the General Terms and Conditions may be consulted.
4.- Intellectual property
The content provided by Autocareslact.com is subject to intellectual and industrial property rights and is the exclusive property of Autocares Lact, S.L. or of the natural or legal persons indicated. By purchasing a product, Autocareslact.com does not grant the purchaser any right to modify, exploit, reproduce, distribute, or publicly communicate it, and Autocareslact.com reserves all such rights. Any assignment of the aforementioned rights shall require Autocareslact.com’s prior written consent.
Intellectual property extends, in addition to the content included on Autocareslact.com, to its graphics, logos, design, images, and the source code used for its programming.
5.- Use of the service and responsibilities
Autocareslact.com does not guarantee the permanent availability of the services and is exempt from any liability for any damages that may be caused due to service unavailability as a result of force majeure or errors in data transfer telematic networks beyond its control.
Autocareslact.com is not responsible for the content of links to other websites that are not owned by it and therefore cannot be controlled by it.
The customer states that they are aware that the information provided by Autocareslact.com through its services is not of a legal nature and is offered for informational purposes only.
6.- Privacy and Personal Data Protection
By providing an email address or other personal data, a requirement necessary for contracting certain services, Customers give their permission for such addresses to be processed and also used to send commercial communications promoting or advertising the services and products offered by Autocareslact.com. Autocareslact.com provides Customers with the email address [email protected] and the telephone number 954 63 02 04 so that they may withdraw the consent given.
Autocareslact.com declares that it complies with current data protection regulations, in particular Organic Law 15/1999, of 13 December, on the Protection of Personal Data, and Royal Decree 994/1999, of 11 June, which implements said organic law. Autocareslact.com provides Customers with the contact details referred to in the previous paragraph so that they may exercise the rights of access, rectification, cancellation, and objection guaranteed by current legislation.
7.- Applicable law and competent jurisdiction.
These General Terms and Conditions shall be governed by and interpreted in accordance with the laws of Spain.
8.- Notifications
All notifications, requirements, requests, and other communications to be made by the parties in relation to these General Terms and Conditions must be made in writing and shall be deemed to have been duly made when delivered by hand or sent by ordinary mail to the other party’s address or to its email address, or to any other address or email address that either party may indicate to the other for these purposes.
9.- Nullity and ineffectiveness of the clauses
If any clause included in these General Terms and Conditions is declared, in whole or in part, null and void or ineffective, such nullity or ineffectiveness shall affect only that provision or the part thereof that is null and void or ineffective, and the General Terms and Conditions shall remain in force in all other respects, with such provision, or the affected part thereof, being deemed not to have been included.
